Frequently Asked Questions (FAQ)
Q: Why was my auction suspended?
A: We asked eBay to suspend your auction because Medusa believes that the merchandise that you were offering for sale is counterfeit or otherwise infringes Medusa’s trademarks. Because of how eBay works, we can only make this determination based upon your auction's title/description/photographs.
Q: Why did eBay allow me to post my auction?
A: eBay maintains that it cannot conduct a comprehensive pre-screening of their auctions. The fact that eBay permitted your item(s) to be listed for sale does not mean that their sale is legal or that they do not infringe Medusa’s trademarks or other intellectual property rights.
Q: Why does MEDUSA care if I sell a single piece of unauthorised MEDUSA merchandise?
A: Medusa has spent large sums of money to develop and maintain its reputation for style and quality. Sellers of counterfeit merchandise attempt to trade off of Medusa’s well-earned reputation. Sales of counterfeit goods damage Medusa’s reputation, as many of the purchasers of inferior counterfeit products will attribute the poor quality merchandise to Medusa .
Q: I think that the item I offered is genuine. How can I tell if it is real?
A: We cannot provide the public with detailed information on how to identify genuine Medusa items; such information could be used by counterfeiters to improve their bogus products. The only way you can be certain that you are purchasing a genuine Medusa fashion product is to purchase from either the Medusa eBay store or directly from our website.
Q: Why can't I use the word "MEDUSA" in my auction heading even though I am not selling a MEDUSA item?
A: Some eBay sellers use the trade marked term "MEDUSA" in their auction title or description simply to get attention from consumers looking for authentic MEDUSA goods. This is a form of trade mark infringement recognised by the courts and legislation whereby the unauthorised use of our trade mark causes a purchaser to believe goods are either affiliated with Medusa or are those of Medusa. This is also recognised as common law ‘passing off’ in the UK, Canada and Australia. Even though consumers may ultimately realise that an auction, product or website has no connection to Medusa, such conduct is an illegal trade mark infringement, and is an attempt to take a free ride off Medusa’s name and reputation.
Q: Why can't I describe my item as "MEDUSA-STYLE", "MEDUSA-LIKE" or a similar phrase?
A: Due to Medusa’s positive reputation, a person who sees the MEDUSA name is likely to believe that the goods are in some manner connected with or endorsed by Medusa. Such confusion as to association or sponsorship is a form of trade mark infringement and violates federal and state laws.
Q: Why didn't MEDUSA contact me directly before reporting my auction to eBay?
A: For reasons of speed and efficiency, it is impractical to contact each seller individually. In order to maintain its reputation and name, Medusa must work diligently and speedily to protect its reputation for providing the highest quality products, and to stop the sale of inferior products under its name and trade marks.
Medusa Does Enforce it's Intellectual Property Rights
Medusa intends to cooperate fully with law enforcement officials to stop any counterfeiting of its name and/or products. Medusa takes full advantage of all criminal and civil legal remedies it may have to enforce its trademark rights.
